Objecting to an application of Town Planning

If you have heard in the local news, seen a local ad, or received notice in writing that there is a development going to happen and think you may be impacted, you need to see the plans. To do this you may have to visit the town planner Brisbane office, or wherever you are based. In some places, they will mail them to you if requested. Once you have seen the plans of you want to object to the application here are some steps to follow.

Does it have a negative impact on you?

Once you have seen the plans you can better judge whether this will have a negative impact on you. To better understand what the council will respond to in your objection you need to think of it in the terms they set. The kind of impact examples that you would need to state include something along the lines of;

  • The backyard is shaded by the proposed work

  • The work would overlook your yard, home, into windows thereby creating a privacy issue

  • The look of the street is negatively impacted

  • The building is too close, too large, or too bulky and creates a negative visual impact

  • It will cause traffic issues, or create car parking issues

Structuring your objection

The type of impact it has on you are the grounds or the basis of your objection. You need to tell the council in your objection in a clear and well-written manner. When writing to town planning, Brisbane or where you are, try to use bullets or numbering to lay out your points, and use headings to highlight each concern you have. If you can, type it and print it off so that they are not struggling to read a handwritten note. Alternatively, there are objection forms you can use from the council and with comes information on how to proceed and what information to give. Make sure whichever way you write it that it has the application reference number and the address, as well as your details for contact.

Petitions

Sometimes those that are opposed may group together and organise a petition against the application too. If you are a part of that make sure each person that signs also includes their name and residence. An individual objection though is more likely to get your specific concerns heard with the town planner Brisbane. The benefit to this too is that the council will inform you of their decision and if you want to object you then have a chance.

These are not anonymous

Be aware that any objections you are a part of is not going to be anonymous. The applicant will know that you have objected, often the council will send a copy to the applicant so they have a chance to respond to it.

Summary

There is a lot to consider with applications to town planning Brisbane, and how proposals impact others is an important part of the process. If you have concerns, make them clear but within the means you have to object.
